Charges Against Jolly Dismissed; Though Case Likely to be Refiled

It looks like Packers DT Johnny Jolly will be on the field after all for the Pack, as the drug possession case against him was dismissed this morning. But, before Jolly celebrates his win, he should be aware that prosecutors are expected to refile the case soon.

The charges come from Jolly being arrested in Houston last July for possession of codeine and indicted for possession of a controlled substance. The arrest took place on October 1st. The dismissal of the case comes from the fact that Houston’s police department crime lab doesn’t seem to be able to know how to measure the amount of codeine in a substance.

“Lab personnel have to learn how to use the instrument and to testify about the results,” attorney spokeswoman Donna Hawkins said Thursday. “Once they receive that training, the case will be refiled. Hopefully that will be within the next 90 days.”

Jolly was scheduled to go to trial on the lone felony Friday and faced up to 20 years in prison if convicted.
